Terms of service

1. General Provisions

These Terms of Service govern the provision of online services on the Charge&Sleep platform available at chargeandsleep.com. The service provider is MTBIZ Marcin Tymków, Michałowice 61, 49-314 Michałowice, Poland, tax ID (NIP): 747 191 21 58 (the “Provider”). Using the service constitutes acceptance of these Terms and the Privacy Policy.

2. Service Description

Charge&Sleep is a directory and search tool for accommodations with EV charging infrastructure. The service is not a booking engine — it does not process payments for stays and does not manage reservations. Booking links redirect to external partner services (such as Booking.com).

3. User Account

Registration requires an email address, a password and acceptance of these Terms and the Privacy Policy. Accounts are free and optional. Users are responsible for keeping their password confidential and for all activity performed from their account. Creating accounts using bots, under other people's data, or for spam purposes is prohibited. Users can delete their account at any time — see the Privacy Policy for details.

4. User-Generated Content

Users may submit stay ratings, comments, charger status reports and photos of chargers and facilities (the “Content”). By submitting Content, users warrant that it (a) complies with the law and fair practice, (b) does not infringe third-party rights, (c) they hold the copyright or required permissions (for photos), and (d) reflects their genuine experience.

5. Content Licence

By submitting Content, users grant the Provider a non-exclusive, royalty-free, worldwide licence to display, crop, compress and present it within the service and in materials promoting the service (for example social-media previews). The licence applies for as long as the Content is published on the service. Users retain all copyright in their Content.

6. Moderation and Removal

The Provider does not carry out prior moderation of Content but reserves the right to remove or edit it without notice if it violates these Terms, the law or fair practice. Users can report infringing Content at hello@chargeandsleep.com; reports are reviewed within a reasonable time.

7. Data Accuracy and Informational Nature

Charger, spec and facility data originate from public databases (such as OpenStreetMap, Open Charge Map), user submissions and hotel-provided information. The Provider uses reasonable efforts to keep the data current but does not warrant its completeness, correctness or availability at any given time. The service is informational in nature — we recommend confirming charger availability directly with the facility before arrival.

8. Affiliate Links

The service uses affiliate links to booking platforms (such as Booking.com). Clicking a link and completing a booking may generate a commission for the Provider from the partner — this does not affect the price paid by the user.

9. Prohibited Activities

Prohibited activities include: posting false, misleading, fictitious, promotional (without Provider consent) or offensive Content; systematic data scraping without Provider consent; disrupting the service (attack attempts, circumventing security); impersonating other persons, facilities or organisations; using the service for any unlawful purpose.

10. Technical Requirements

Use of the service requires: an up-to-date web browser with JavaScript and cookies enabled, an internet connection and an email address for registration. The service is provided as-is; the Provider uses reasonable efforts to keep it available but does not warrant uninterrupted availability.

11. Liability

To the extent permitted by law, the Provider is not liable for: Content submitted by users; inaccuracies in charger data sourced from public databases; damages arising from charging-infrastructure failures at partner facilities; service interruptions caused by circumstances outside the Provider's control. These limitations do not apply to consumers with respect to rights under mandatory law.

12. Complaints

Complaints regarding service operation may be submitted to hello@chargeandsleep.com. A complaint should include the user's login or email, a description of the issue and the expected resolution. The Provider will respond to complaints within 14 days of receipt, by email.

13. Right of Withdrawal (Consumers)

A user who is a consumer under applicable law may withdraw from the agreement for online services within 14 days of registration, without stating a reason, by deleting their account or sending a notice to hello@chargeandsleep.com.

14. Changes to Terms

The Provider may update these Terms for important reasons (functional, legal or security changes). Registered users will be notified of material changes at least 14 days in advance by email and by an in-service notice. Continued use after the effective date constitutes acceptance; a user may delete their account at any time.

15. Dispute Resolution and Governing Law

These Terms and the online-services agreement are governed by Polish law. Disputes arising from use of the service may be resolved amicably; failing agreement, the competent court shall be the court for the Provider's registered address, subject to rules protecting consumer jurisdiction. Consumers also have access to out-of-court dispute resolution (the EU ODR platform: ec.europa.eu/consumers/odr).
